Terms of Service

By accessing or using HomeThink (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

HomeThink is operated by HomeThink (“we”, “us”, or “our”). These Terms constitute a legally binding agreement between you and HomeThink.

HomeThink is an AI-powered property research tool for UK home buyers and renters. The Service provides:

• AI analysis of property listings from Rightmove, Zoopla, and OnTheMarket
• Red flag and green flag identification
• Property valuations and neighbourhood intelligence
• Survey risk predictions and negotiation strategy
• Interactive chat with AI about properties
• Enrichment data including crime statistics, flood risk, council tax, and local amenities

Pro features require an active HomeThink Pro subscription.

3.1 Account Creation

To use HomeThink, you must create an account by providing a valid email address. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are responsible for all activity that occurs under your account. Notify us immediately at privacy@homethink.co.uk if you suspect unauthorised access to your account.

3.3 Eligibility

You must be at least 18 years old to use HomeThink. By using the Service, you represent that you meet this age requirement.

4.1 Free Analysis

New users receive one free Pro property analysis upon account creation. This allows you to experience the full HomeThink Pro experience before subscribing.

4.2 Subscription Plans

HomeThink Pro features require a subscription at £10/month. A Pro subscription gives you unlimited Pro property analyses, AI chat, and all enrichment data for as long as your subscription remains active.

4.3 Billing and Renewal

Subscriptions are billed monthly on the anniversary of your sign-up date. All payments are processed securely through Stripe. We accept major credit and debit cards. Prices are listed in GBP and include any applicable VAT.

4.4 Cancellation

You may cancel your subscription at any time from the Billing section in your account settings. Your subscription will remain active until the end of the current billing period. No refunds are issued for unused time within a billing period.

4.5 Payment Failures

If a subscription payment fails, we will retry the charge and notify you by email. Access to Pro features may be suspended if payment cannot be collected. Contact us at privacy@homethink.co.uk if you experience billing issues.

4.6 Price Changes

We may change subscription pricing with at least 30 days' notice. Price changes will be communicated by email and will take effect at your next billing renewal.

You agree to use HomeThink only for lawful purposes and in compliance with these Terms. You agree NOT to:

• Use the Service for any illegal or fraudulent activity
• Attempt to reverse-engineer, decompile, or extract AI models or algorithms
• Use automated scraping, bots, or scripts to access the Service excessively
• Violate any applicable laws or regulations
• Impersonate any person or entity
• Share your account credentials with others
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to harm, harass, or discriminate against others

6.1 AI-Generated Content

The AI analyses, insights, red/green flags, valuations, and chat responses generated by HomeThink are original works owned by HomeThink. You are granted a personal, non-transferable licence to use this content for your own property research purposes.

6.2 Property Listing Content

Property listing descriptions, photographs, and details remain the intellectual property of the respective listing portals (Rightmove, Zoopla, OnTheMarket) and estate agents. HomeThink does not claim ownership of this content and retrieves it solely at your direction for analysis.

6.3 Service Marks

HomeThink, the HomeThink logo, and related marks are trademarks of HomeThink. You may not use our trademarks without prior written permission.

7.1 Not Professional Advice

HomeThink's AI analysis is provided for informational purposes only and does not constitute:

• Legal advice or property law guidance
• Financial or mortgage advice
• Surveying or structural engineering advice
• Investment or tax advice
• Formal property valuation reports

Always consult qualified professionals (solicitors, surveyors, mortgage advisors, financial advisors) before making property decisions.

7.2 AI Accuracy

While we strive for accuracy, AI-generated content may contain errors, omissions, or inaccuracies. HomeThink is not liable for decisions made based on AI analysis. You must independently verify all information before taking action.

7.3 Third-Party Data

Enrichment data (crime statistics, flood risk, council tax, etc.) is sourced from third-party public APIs and may be outdated or incomplete. We make no guarantees about the accuracy or completeness of this data.

To the fullest extent permitted by law:

• HomeThink is provided “as is” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not guarantee that the Service will be uninterrupted, secure, or error-free.
• We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service, including lost profits, property damage, or financial losses.
• Our total liability to you for any claims related to the Service shall not exceed the amount you paid in subscription fees in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot be excluded under UK law.

You agree to indemnify and hold HomeThink, its officers, directors, employees, and agents harmless from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws

10.1 By You

You may terminate your account at any time by contacting us at privacy@homethink.co.uk. No refunds are issued for the unused portion of an active subscription period upon termination.

10.2 By Us

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any reason at our sole discretion. We will provide notice where reasonably practicable.

10.3 Effect of Termination

Upon termination, your access to the Service will cease immediately. We will retain your data as described in our Privacy Policy.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on our website. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12.1 Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

12.2 Dispute Resolution

Before initiating legal proceedings, please contact us at privacy@homethink.co.uk to attempt to resolve the matter informally.

13.1 Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and HomeThink regarding the Service.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.
